The 5-Year Indefinite Leave to Remain (ILR) route allows individuals who have lived in the UK lawfully on an eligible qualifying visa for five continuous years to settle permanently. This is the primary path to settlement for workers, business professionals, and family members of UK residents.

Core Eligibility Requirements

To secure settlement through the 5-year route, you must meet the following general criteria alongside the specific rules of your visa category:

5-Year Threshold: You must have completed 5 years of continuous, lawful residence in the UK on an eligible visa pathway.
Knowledge of Life and Language: You must pass the “Life in the UK” Test and meet the English language requirement (at least CEFR Level B1 in speaking and listening) unless you are exempt due to age (under 18 or 65+) or a certified medical condition.
General Grounds: You must have a clean immigration history. The Home Office will check for any criminal convictions, unpaid NHS debts, or previous immigration breaches that could lead to a refusal under the “General Grounds for Refusal.”
Route-Specific Rules: You must continue to meet the specific requirements of the visa you currently hold (e.g., minimum salary for workers, or ongoing relationship for spouses).

Eligible Visa Categories

Unlike the 10-Year Long Residence route, you generally cannot combine completely different visa types (like Student and Worker) to make up the 5 years. You must usually complete the 5 years on one specific settlement path, which includes:

Skilled Worker Visa
Spouse or Partner Visa (5-Year Route)
Global Talent Visa (can be 3 or 5 years depending on endorsement)
Innovator Founder Visa (can be 3 or 5 years)
UK Ancestry Visa

(Note: Time spent on a Student Visa, Graduate Visa, or as a standard Visitor does not count towards the 5-year ILR route).

The 180-Day Continuous Residence Rule

A critical requirement for the 5-year route is proving that your residence in the UK has been “continuous.”

Absence Limits: For most visa categories (like Skilled Worker or Global Talent), you must not have been outside the UK for more than 180 days in any rolling 12-month period during the 5 qualifying years.
Spouse/Partner Exception: If you are on a family visa (Spouse/Partner), the strict 180-day rule is traditionally not explicitly applied in the same mathematical way, but you must still prove that the UK has been your permanent home and your absences were temporary.

Route-Specific Requirements at the Settlement Stage

Depending on the visa category you are using to apply for ILR, the Home Office requires specific proof that you still qualify:

For Workers: You will need a letter from your sponsor confirming that you are still needed for your job and that you meet the relevant minimum salary threshold for ILR.
For Spouses/Partners: You will need to provide extensive cohabitation documents proving that you and your partner have lived together continuously and intend to live together permanently in the UK.

When to Apply and Decision Times

Application Window: You can apply up to 28 days before you reach your 5-year qualifying period. Applying too early will result in a refusal.
Processing Times: Standard processing for ILR takes up to 6 months. However, many applicants opt for Priority (5 working days) or Super Priority (next working day) services for an additional Home Office fee.
