EU Settlement Scheme (EUSS)

The EU Settlement Scheme was created to protect the rights of EU, EEA, and Swiss citizens who were living in the UK by December 31, 2020. In 2025 and 2026, the Home Office introduced major updates to simplify how people move from temporary status to permanent residency.

EU Settlement Scheme (EUSS)

Pre-Settled Status (Limited Leave)

This is a temporary status for those who had lived in the UK for less than 5 years by the Brexit deadline.

Duration: Valid for 5 years.
2026 Update (Automatic Extensions): If you haven’t yet applied for Settled Status, the Home Office now automatically extends your Pre-Settled Status by a further 5 years shortly before it expires. You will receive an email confirmation, and your digital status will update automatically.
Rights: You have the full right to work, study, and use the NHS. You can spend up to 2 continuous years outside the UK without losing this status (though long absences may affect your ability to get Settled Status later).

Settled Status (Indefinite Leave to Remain)

This is permanent residency, granted once you have lived in the UK for a qualifying period.

Duration: Permanent (does not expire).
Absences: You can spend up to 5 years (4 years for Swiss citizens) outside the UK without losing your status.
Citizenship: You can usually apply for British citizenship after holding Settled Status for 12 months.

New 2026 Residence Rules

As of July 2025 and fully implemented in early 2026, the Home Office simplified how “continuous residence” is calculated for Settled Status. You can now qualify if:

Standard Rule: You have 5 years of residence with no more than 6 months of absence in any 12-month period.
The New 30-Month Rule: You have been resident in the UK for at least 30 months (2.5 years) within the last 5 years, provided you first arrived in the UK at least 5 years ago.

Note: This new rule is much more flexible, as you no longer need to provide detailed “important reasons” for every absence, as long as you hit the 30-month total.

Automated Conversion

The Home Office now uses HMRC (tax) and DWP (benefits) records to automatically upgrade people from Pre-Settled to Settled Status.

How it works: If government records show you meet the residence requirement, you will be sent an email confirming you have been granted Settled Status automatically. No application is needed.
Who must still apply manually? You should still submit a manual application if:
- You are a non-EEA family member.
- You have not been working or receiving benefits (meaning there are no tax records for you).
- You are under 18 years old.

Late Applications

While the main deadline was June 30, 2021, you can still make a late application if you have “reasonable grounds” for the delay.

Accepted Grounds (2026): Serious medical conditions, being a victim of domestic abuse, or cases where a parent failed to apply for a child.
Strict Assessment: Since August 2023, the Home Office has become much stricter. “Forgetting” or “being unaware of the deadline” is generally no longer accepted as a valid reason.

Digital Status and Traveling

eVisas: There are no physical cards. You must keep your UKVI account updated with your current passport number.
Travel Checks: Starting in February 2026, carriers (airlines/ferries) perform real-time digital checks. If your passport isn’t linked to your digital status, you may be denied boarding.
