What Counts as Grounds for Asylum?

- Political Opinion: Persecution due to your political beliefs, activism, or vocal opposition to ruling regimes.
- Religion or Belief: Targeting based on your religious practices, conversions, or lack of religious belief.
- Race or Nationality: Systemic harm or discrimination based on your ethnic background, race, or origin.
- Particular Social Group: Persecution due to characteristics you cannot change, such as your gender, sexual orientation, or specific family background.
- Humanitarian Protection: For individuals who do not strictly qualify as refugees but still face a real risk of serious harm, such as torture or inhuman treatment.
The Golden Rule: You must claim asylum as soon as you arrive in the UK, or as soon as you realise it is no longer safe to return to your country. Unreasonable delays in declaring your claim can negatively impact how the Home Office assesses your credibility.
Protection Rules and Policy Changes
The UK asylum system operates under revised structural rules for claims registered on or after 2 March 2026.
- 30-Month “Core Protection” Limit: For claims made on or after 2 March 2026, successful adult applicants and accompanied children are granted 30 months (2.5 years) of temporary protection, rather than the previous 5-year standard.
- Mandatory Safe-Return Reviews: Near the end of the 30-month period, the Home Office will conduct a formal review to determine whether conditions in your home country have improved sufficiently to allow safe return before renewing your status.
- Unaccompanied Minors: Unaccompanied asylum-seeking children are generally exempt from this 30-month limit and continue to receive a 5-year grant of permission to stay.

- Screening Interview: Your claim is officially registered, your biometrics are taken, and basic questions about your identity and travel route are asked.
- Preliminary Assessment: The Home Office reviews whether your claim can be considered in the UK under “third country” inadmissibility rules.

Processing Times
The timeline for receiving an asylum decision varies depending on the complexity of your case and Home Office processing times.
- Standard Wait: The Home Office aims to process straightforward claims within six months, although some cases may take longer.
- Complex Claims: More complex cases can take 12 months or longer. During this period, eligible applicants who would otherwise be destitute may receive basic accommodation and financial support.
