Common Routes to Registration

There are several different “sections” of the law under which a child can be registered. The most common are:

1. Born in the UK: Parents became British or Settled (Section 1(3))

If a child was born in the UK to parents who were not British or settled at the time, but one parent has since obtained Indefinite Leave to Remain (ILR), Settled Status, or British citizenship:

Form: MN1
Requirement: The child must be under 18 and at least one parent must now be “settled” or British.

2. Born in the UK: Lived here for 10 years (Section 1(4))

This is an entitlement that exists regardless of the parents’ immigration status.

Form: T
Requirement: The child was born in the UK and has lived here for the first 10 years of their life.
Absences: The child must not have been out of the UK for more than 90 days in any single year of those 10 years. (The Home Office has some discretion to ignore slightly longer absences for compelling reasons).

3. Born Outside the UK: Parents applying for citizenship (Section 3(1))

This is a discretionary route. The Home Office usually grants this if the child is living in the UK and it’s clear their future lies here.

Requirement: Usually, at least one parent is applying for (or already has) British citizenship, and the other parent is “settled.”

2026 Costs and Fees

The fees for child registration are lower than adult naturalisation but still significant.

Fee Waivers: Since 2022, you can apply for a fee waiver for child registration if you can prove you cannot afford the fee. If granted, the entire £1,214 fee is removed.
Refunds: If the application is refused, the Home Office will usually refund the fee minus an administration charge (approx. £25), unlike adult naturalisation where the fee is entirely lost.

Key Requirements for 2026

Good Character: If the child is 10 years or older, they must meet the “good character” requirement. This looks at criminal records and any serious behavioral issues (though minor immigration breaches by the parents are usually ignored for children).
Parental Consent: Both parents must usually give written consent for the child to be registered. If one parent is missing or refuses, you must provide a detailed explanation or a court order.
No English/Life in the UK Test: Children do not need to pass the Life in the UK test or an English language exam to register.

Documents Needed

Identity: Child’s birth certificate (showing parents’ names) and any current/expired passports.
Evidence of Parents: Passports or BRPs showing the parents’ status (e.g., ILR or British citizenship).
Residence Proof: For the 10-year rule, you need a “continuous” record of the child’s life, such as:
- School reports or letters from teachers.
- Medical records (GP/Dentist).
- Nursery or childcare records.
