6.1 AI Processing and Explicit Consent

Because immigration casework involves highly sensitive information—including your immigration history, health information, and biometrics—the processing of this data falls under Special Categories of Personal Data (GDPR Article 9).

We will never process your special category data through AI tools without your explicit, written consent. You will be asked to actively check a consent box confirming:

“I confirm explicit consent for my personal data (including immigration and health information) to be processed by AI tools for case preparation purposes, in accordance with GDPR Article 9.”

When you grant explicit consent, our AI tools are used strictly internally for the following purposes:

  • Assisting our consultants in drafting legal representations, cover letters, and appeal documents.
  • Cross-referencing your provided documents against Home Office guidelines to identify missing information.

6.3 Security and AI Sub-Processors

We only use enterprise-grade AI tools that comply with UK GDPR standards.

  • Confidentiality: Any data processed by our AI tools is encrypted and strictly ring-fenced.
  • No Public Training: Your personal and special category data is never used to train public AI models (such as the public versions of ChatGPT).
  • Human Oversight: AI is used purely as an assistive tool. Every document, application, and piece of legal advice is rigorously reviewed, edited, and signed off by a qualified, IAA-registered human consultant before being submitted to the Home Office.

You have the absolute right to withhold or withdraw your consent for AI processing at any time without it affecting your right to our services. If you withdraw consent, your case will be prepared manually, though this may impact processing times.


7. Data Security

We have put in place robust, enterprise-grade security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a strict business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

To ensure our clients are financially protected, Wise Immigration Ltd holds comprehensive Professional Indemnity Insurance. We confirm that our liability to you for any claim or loss arising out of, or in connection with, the provision of our professional services is covered up to a maximum of £250,000 for each and every claim or loss, excluding defence costs.
